By submitting an order and/or payment, You are acknowledging that You have read and understand these terms and conditions. By submitting an order and/or payment, You are also agreeing to be legally bound by these terms and conditions, which form the entire agreement between You and Creative Writers LLC.

Definition of Terms

"Website" means all online content on Creative Writers LLC website pages.

"Customer," "You," or "Yours" mean and refer to you and/or any other person submitting an order to Creative Writers LLC on your behalf.

"Company," "We," or "Our" mean and refer to Creative Writers LLC, a company registered under the laws of Massachusetts.

"Product" means and refers to all services and products provided by Creative Writers LLC to Customer in accordance with his/her Order.

"Order" means an order via phone or e-mail made by Customer to purchase services or products provided by Creative Writers LLC. Orders are confirmed by down payments via credit card, cash receipt or bank wire transfer

REFUND POLICY

It is important that you read and fully understand the refund policy in order to have full knowledge of the privileges and limitations governed by the Creative Writers LLC Policy. We offer refunds only in special cases and specified conditions, detailed as under:

Change of Mind

The customer is entitled to 1000% refund before our writers/editors start working on the project. If (for any reason) you change your mind and decide against continuing your project with us after placing your order, you can ask for refund within the first hour of placing your order. A 15% processing fee will be charged in other cases.

Incompetent Delivery

Once the work is delivered, customers are only entitled to claim a refund once they have exhausted all the options detailed as under; If it does not comply with project requirements (as requested/documented by the customer). We are committed to provide our customers with 100% satisfaction and offer unlimited revisions to ensure that the delivery is up to the mark. We assign, re-assign and re-write your work to ensure complete satisfaction. Reserve FREE Pages for future, but of same value and you can avail them at any time. If we're still not able to deliver what you asked for, refund will be processed with a mutual agreement on a set percentage (but only in the cases where the delivery is completely off the mark)

Late Delivery

We believe in "On Time Delivery" but if, for any reason we fail to deliver the asked service on time, after at least three attempts to contact us, your refund will be processed once it is established through documentary evidence that the late delivery was the company’s fault.

Refund Time Frame

Refunds must be claimed within 60 days of delivery. Refunds claimed after the set time frame will not be entertained. All the customers must note the deadline for claiming refund at the time of placing order.

Cases where refund will not be issued

In case of late delivery due to some minor technical errors, such as grammatical, typing, word count, missing references etc., refunds will be processed with mutual agreement and the company will only settle with partial refund or discounts reserved for future purchases. The company will not be responsible for any delay from the client’s end.

Clause of Use

If a project has been abandoned in terms of approvals or specifications, based on the lack of any written communication between the client and the account manager for a period of at least 45 days then the project will be deemed as closed. Fees will be charged to Reactivate the project.

Closed Project

“Closed Project” is a project that has been either delivered in full or wasn’t claimed for a period of at least 45 days and Creative Writers LLC cannot be held liable after the stated time duration.

Copyright & Personal Use

The Products delivered to You are completely original content. The full copyright to the Products and other materials delivered to you is retained by you and you alone. You agree to indemnify, defend, and hold harmless the Company for any and all unauthorized uses you may make of any material available made available to you by Company. Any unauthorized use of the delivered Products and/or content of this Website may subject you to civil or criminal penalties.

No Plagiarism

We do not condone, encourage, or knowingly take part in plagiarism or any other acts of fraud or dishonesty. We strongly adhere to and abide by all copyright laws, and will not knowingly allow any Customer to commit plagiarism or violate copyright laws. Neither the Company nor any of its affiliates and/or partners shall be liable for any unethical, inappropriate, illegal, or otherwise wrongful use of the Products and/or other written material received from our Website. This includes plagiarism, lawsuits, poor grading, expulsion, academic probation, loss of scholarships/awards/grants/prizes/titles/positions, failure, suspension, or any other disciplinary or legal actions. The buyer of material from our Website is solely responsible for any and all disciplinary actions arising from the improper, unethical, and/or illegal use of the material.

Our policy for using images

We do not own the copyright of images unless specifically designed by our in-house illustrators - hence we do not use copyright images by ourselves. We will simply provide you links of recommended images so you can copy and place by yourself. You may use royalty free images without any worry, however for copyright images you may require to pay the owner(s).

Refunds

We will refund 100% of paid fee if you make request for refund before we start working on your ordered product (except the transaction charges that will be deducted). Once an order is delivered you are no longer eligible to ask for 100% refund. Once an Order has been started, the hours put into the project cannot be recuperated and thus we will not provide a refund. The Products and Services offered are non-refundable and come with no warranties, expressed or implied. However, you may ask for up to 1 revision free of charge. In case you are not 100% satisfied with the quality of product/ services, you may ask for 50% refund against the paid fee amount. We will process the refund of 50% fee amount subject to verification of the quality concerns you would claim. In case you have a special complaint scenario and demand full fee amount refund then your case shall be forwarded to evaluation-committee and they will take an impartial decision based upon facts and evidences.

Limitations on Revisions

Editing Orders: We will revise edited content to ensure that no objective or technical errors remain. If no objective or technical errors remain in the content, any further revisions to that content are provided at the sole discretion of the Company. Ghostwriting Orders: We will revise small segments of written material until that segment is approved by the Client. Once the Client approves of the content that we develop, revisions to that content will be billed at an appropriate editing rate.

Limitation Of Liability

You agree to release and hold the Company and its employees, officers, directors, shareholders, agents, representatives, affiliates, subsidiaries, advertising, promotion and fulfillment agencies, any third-party providers, or sources of information or data and legal advisers (the “Company’s Affiliates”) harmless from any and all losses, damages, rights, claims, and actions of any kind arising from or related to the Products, including but not limited to: (a) telephone, electronic, hardware or software, network, Internet, email, or computer malfunctions, failures or difficulties of any kind; (b) failed, incomplete, garbled or delayed computer transmissions; (c) any condition caused by events beyond the control of the Company that may cause the Product to be delayed, disrupted, or corrupted; (d) any injuries, losses or damages of any kind arising in connection with or as a result of utilizing our services; or (e) any printing or typographical errors in any materials associated with our services. In addition, you agree to defend, indemnify, and hold the Company and Company’s Affiliates harmless from any claim, suit or demand, including attorney’s fees, made by a third party due to or arising out of your utilizing of our services, your violation or breach of these Terms and Conditions, your violation of any rights of a third party, or any other act or omission by you. In no event shall the Company be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of or in any way connected with the use of this Website or any information provided on this Website. Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.
